PRIVACY POLICY FOR THE ONLINE PLATFORMS AND WEBSITES OF “THE MARKTING JERSEY” (hereinafter, the “Privacy Policy”).
The Marketing Jersey, LLC, a Texas limited liability company, along with its affiliated entities (hereinafter referred to as, the “Company” or “TMJ” interchangeably), is responsible for the treatment of the user’s personal data collected across the Company’s digital platforms, specifically through websites owned or controlled by the Company (hereinafter, collectively referred to as, the “Website” or “TMJ’s Website”).
This Privacy Policy’s purpose is to establish and inform, among other things, the general terms and conditions under which TMJ may collect, use and/or disclose individually identifying or identifiable information of its users and visitors. TMJ will not use, collect, or disclose its user’s personal information except as explicitly established in this Privacy Policy.
This Privacy Policy does not apply to the personal information of TMJ’s talent or collaborators.
Personal Information.
TMJ may collect data that is linked or reasonably linkable to an identified or identifiable individual, in the usage of TMJ’s digital platforms when such data is voluntarily submitted through this Website or when applicable in the Website’s cookie recollection, meaning the following information (collectively, “Personal Information”):

- Information regarding the Website’s usage:

No sensitive Personal Information, such as Biometric information, including facial recognition, fingerprints, iris or retina scans, keystroke or other physical patterns, as well as National or government identifiers, will be collected from you in interacting with TMJ’s Website. Any sensitive data processing (if it ever were to occur) will require explicit consent from the user, as per Section 541.101(b)(4) of the Texas Data Privacy and Security Act.

TMJ collects and processes Personal Information for the following purposes:
- Primary purposes:
- To respond to inquiries submitted through TMJ’s digital platforms;
- To add users to TMJ’s email list for updates, newsletters, or other relevant communications;

To determine the appropriate retention periods for all Personal Information, TMJ considers the amount, nature and sensitivity of the Personal Information, legal requirements, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process the Personal Information and whether we can achieve those purposes through other means.

- Access: Users may request confirmation of whether TMJ processes their Personal Information and obtain a copy of such data.
- Correction: Users may request correction of inaccuracies in their Personal Information.
- Deletion: Users may request the deletion of their Personal Information.
- Portability: Users may request a copy of their Personal Information in a portable format.
- Opt-Out: Users may opt out of receiving marketing communications or the processing of their data for targeted advertising purposes.

Appeals process
- If TMJ denies a user’s request related to their personal data (e.g., access, correction, or deletion), the user will be informed of the denial and the reason for it within the standard response period (45 days).

- Minor Usage
TMJ’s Website is not directed at children under the age of 13 (“Minors”). In the event that TMJ becomes aware that it has inadvertently collected Personal Information from a Minor, TMJ will promptly delete such information from its records. - Retention and Deletion of Data.
TMJ retains Personal Information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy. Users may request the deletion of their Personal Information as described under Consumer Rights. TMJ may (at its own discretion) follow the guidelines outlined below regarding data retention:

- Email Lists and Subscriptions: Retained until the user opts out or unsubscribes from the service. Unsubscribed data will be deleted within 90 days.
